By accessing or using Aesthatech ("the Service", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms apply to all visitors, users, and others who access or use the Service.
2. Description of Service
Aesthatech is a business management and client relationship platform designed for independent beauty and wellness professionals. The Service includes tools for client management, service tracking, scheduling, content planning, and AI-powered insights.
3. User Accounts
- You must be at least 18 years old to create an account.
- You are responsible for maintaining the confidentiality of your account credentials.
- You agree to provide accurate, current, and complete information during registration.
- You are responsible for all activities that occur under your account.
- You must notify us immediately of any unauthorized use of your account.
4. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law or regulation, including HIPAA or data protection laws.
- Store or process protected health information (PHI) in a manner that violates healthcare privacy laws, unless you have separately secured appropriate compliance measures.
- Infringe upon the intellectual property rights of others.
- Distribute malware, spam, or other harmful content.
- Attempt to gain unauthorized access to the Service or its related systems.
- Use the Service in any way that could damage, disable, overburden, or impair it.
5. Data Ownership & Privacy
- You own your data. All client records, business information, and content you enter into Aesthatech remains your property.
- We act as a data processor on your behalf. Our collection, use, and protection of personal data is governed by our Privacy Policy.
- You are responsible for ensuring you have the legal right to store and process any personal data you upload about your clients.
- We do not sell your data or your clients' data to third parties.
6. AI-Powered Features
- Smart Actions, Smart Insights, and the Content Planner use Anthropic's Claude API to generate recommendations.
- AI outputs are generated suggestions and should not be considered professional, legal, medical, or financial advice. You are solely responsible for reviewing and validating any AI-generated content before using it.
- You must provide explicit consent before using AI features for the first time. You may withdraw consent at any time.
- We pseudonymize client-identifying information before sending data to Anthropic. See our Privacy Policy for details.
7. Subscriptions & Payments
- Certain features require a paid subscription. Pricing is displayed at checkout and may change with 30 days' notice.
- Payments are processed through Stripe. By subscribing, you agree to Stripe's terms of service.
- Subscriptions auto-renew unless cancelled before the next billing cycle.
- You may cancel at any time through your account settings. Refunds are at our sole discretion unless otherwise required by law.
8. Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including breach of these Terms.
Upon termination, your right to use the Service ceases immediately. You may delete your account and all associated data at any time using the account deletion feature or by contacting us.
9. Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of Aesthatech and its licensors. You retain all ownership of the data you upload.
10. Disclaimer & Limitation of Liability
- The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind.
- To the maximum extent permitted by law, in no event shall Aesthatech be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Service.
- Our total liability to you for all claims arising from or relating to these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless Aesthatech and its operators from any claim or demand made by any third party due to your use of the Service, your violation of these Terms, or your violation of any rights of another.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide at least 30 days' notice of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance.
